With facebook and Google+ (mostly facebook) I've kind of slacked on updating my blog. I will make an effort to add updates to it whenever possible from now on. Not sure if anybody reads it, but it's nice to have the memories if anything. Plus I've been posting a lot of different videos and really need to add those here as well.
Anyhoo.. for now, I'm back.. Hopefully for good. :)

Per requests via facebook, I'm going to try to recall everything that happened on that fateful night.

I was 19 when this happened, so it's possible I may leave something out, but I remember it pretty well and since I'm almost 38, this was literally almost 20 years ago.

When I was 19 years old I worked for a local convenience store called Circle-K for those out-of-staters that may not have any idea this store exists. Anyway, it was my day off, however this other guy that worked there was a friend of mine at the time, so I'd go in from time-to-time to see him, even on my day off, as it was about a 2 block walk to the store I worked at. I'd also play video games on the arcade machines this particular store had. My personal favorite was Street Fighter II. On that night the store was packed. It is in a hispanic community, so Jay and I were the only caucasians in the store. I am only mentioning that because it will be relevant to the story later on. I'd say there were probably 35 people in the store that night including the two of us as this store was essentially the local grocery store for the community, as well as one of the local hangouts.

So I was standing at the counter talking to Jay about nothing important when this hispanic gentleman goes over to the vendor chips display and throws it down to the floor muttering something. I told Jay that guy just throw the display down and he said something like it was probably an accident. I told him I'd seen the whole thing and it was NO accident.

The guy then goes outside and starts flipping off any patrons he saw, as well as the gas pumps and 16th Street. We were laughing about it, because he was flipping everything off backwards. Basically, he was flipping himself off instead of others. I thought it was pretty funny to be honest, and I'd laugh again if I saw some idiot doing that. Well, this guy was deranged for sure, and it was pretty evident when one of the patrons in the store yelled "He's got a gun!". It appears he had a truck parked in front of the store, and had decided to get the gun and point that at the gas pumps and 16th Street instead. Unfortunately he didn't point that at himself like the bird.

Obviously by now Jay is on the phone with 9-1-1 and everyone in the store is either ducking behind display cases or in the walk-in-freezer. I'd say most of the group of people in the store ran into the walk-in-freezer. Jay tells me "Dave! Lock the Door! NOW!!!" so I run over to lock the door. The problem is by the time I'd gotten to the door to lock it (top of the door, middle, and bottom) this guy is now walking toward the front doors and has his gun pointed to the temple of another caucasion. He sees me trying to lock the doors and points the gun directly at me, so I back away slowly as he walks in with this guy.

He then tells the person to get down on his knees. I felt really bad for the guy because I could see tears welling up in his eyes and I can only imagine what he was thinking. I know what I was thinking, and it wasn't to be a hero. I'll be honest; I was SCARED SH*TLESS!!! Either way, I will never forget what the person said next:

"I AM THE SON OF JESUS CHRIST. I WILL KILL EVERY ONE OF YOU WHITE MOTHERF*CKERS IN HERE!!!"

Whoa! Did I just hear what I thought I'd heard? Last I saw, there were three of us white motherf*ckers in the store, and one of them was on his knees in front of a madman with a gun. I did something I'm not proud of, but I immediately ran into the back room of the store and locked the door. The whole time I'm in there I'm wondering if I should bolt out the back door and set the alarm off. I figured if I had done that, the guy would have heard and chased me down. I just kind of sat there in shock to be quite honest, or I think I would have moved somewhere else in the room. I was waiting to hear any gunshots and I would have bolted for sure.

The shots never came. In fact, it was eerily silent, so I peeked out of the door to see what was going on. By now it's getting tense, as the guy still was pointing the gun and appeared to have cocked it. He said something that I couldn't make it and the guy on the floor begged for his life. By this time, two drunk hispanics somehow hobbled over and knocked the guy down and grabbed his gun. Seeing as how I worked there, I figured I'd step in and told them to give me the gun as I worked there. They did, and this is of course when about 15 police officers came busting through the front door. They pointed their guns at ME and screamed "Drop the Weapon! Get on the Ground! Get on the Ground!". I tried to tell them I wasn't the guy when they told me again if I didn't drop the weapon I'd be full of holes. I of course dropped the gun and got on the ground.

By this time, Jay is no longer hiding behind the counter (he was the whole time) and tells the cops I was not the guy. I found out after the cops took this guy away that the person he almost killed first had seen him outside pointing the gun at a busy street and had run to a pay phone outside to call 9-1-1 and the guy saw him and grabbed him. I had also found out after the incident that the guy meant business. He had a full clip and a bullet in the chamber.

The gun was a 45 caliber pistol, so I can assume it would have done some damage.

It's actually hard to write this after so many years, especially knowing this maniac is probably out on the streets again by now. Anyhow, that is the story. Again I wrote it because I've been asked a few times to write about my "hostage crisis".

I've had so many bad experiences that I don't even know where to start.

1. Loud talking behind me, next to me, or in front of me (or sometimes all of the above).

I've asked people to STFU politely of course, but most of the time they either get worse at that point or you hear "I'm gonna get you after the movie holmes. You best watch yourself essay." so to avoid being shot, my wife and I usually go out and say we want our money back. We always get the usual "We'll go in and watch". Well at this point you've already missed at least five minutes of the movie and it's not worth it. Plus it does absolutely NO good whatsoever in most instancesI always force them to give me replacement tickets so I can *sigh* try again. Incidentally, I've had experiences where I've had to do that a few times before and just gave up and watched it when it was released on DVD.

2. Laser pens.

Usually a theater will kick you out with no questions asked, but I've had many instances where I was annoyed to death by some idiot a few rows behind me that thought it was hilarious to put a red dot on something on the screen. Usually during the best parts of the movie.

3. Cell phones.

I understand people 'need' to be connected no matter what. I too am on-call occasionally, but a) I have the friggin' thing on vibrate *and* in my pocket and b) if I do get an email or text I lean down and push the button UNDER my seat so as not to disrupt anyone else from their experience. I don't just blatantly look at the damn thing for several minutes at time, pissing everyone off in the theater. Though it makes me wonder sometimes, because I'm usually the one that gets pissed off more than not.

4. Babies.

We just had our first and he is almost a month old. I'm planning on taking my wife to see Avatar this weekend BUT I will NOT do so if we can't get grandma or a friend to babysit. There is no way in HELL I'm going to take my son into a theater while he's so young, as I believe in courtesy to others. One of my worst movie experiences was when we saw 'The Blair Witch Project' and there was a kid constantly running up and down the isles and making noises. My kid will NEVER do that in a public place unless it's acceptable like a kid's fun place or something. The parents (not the kids) should be smacked for allowing that kind of behavior in a public place.

I'm sure there's more, but that's all I can think of.

My son was born on Tuesday, November 24th, 2009. He weighed in at 8lbs, .01oz and was 20.5 inches. I could go on and on about how incredible it is to be a daddy, but I'm so stoked and I wanted to tell the world!

As of today, he is now 7 days old. Tonight he'll be 8 days old. He already can lift his head and he's a strong lil' guy. We lay him down on his back (like we were told for newborns) and within 5mins, he's already turned to his side to go to sleep. I worry a lot about him, but if he's strong enough to turn over (and back), I'm sure he'll be okay.

Last night he held his bottle with both of his hands. He was 7 days old!!! WOW!!!

Well I'm at work and have to go to a meeting so I'll have to follow-up later. I'll post pics too. Please join me in welcoming Rilee to the world, albeit 8 days late. :)

Many of my friends, colleagues, and even my wife have always had a fascination with me and the movie Convoy. WHY do I love this movie so much? WHY am I able to watch this movie over and over and over and over (I'm listening to it now in the background) and over and over and NEVER get tired of it?! To be 100% honest, I really don't know. What is it about a 31 year old movie that keeps me coming back for more? Why do I have such a fascination for a black truck with a chemical trailer on the back?

How is it I don't tire of Martin Penwald, Sheriff Lyle Wallace, Pigpen, Spider Mike, Federal Agent Hamilton, Governor Haskins, Chief Stacey Love, Bob Buckman, The Widow Woman, etc.. etc? The list goes on, but you get the point. I really don't know, but I do have a suspicion: Childhood.

So the movie was made in 1977 and released in 1978 in theaters. It actually made over 46 million, which back then was pretty good. I got to see the movie when it aired on HBO probably a year later. Keep in mind that I was born in 1973, which means I was probably 6 when I first saw the movie. I still remember back in the day when I was completely mesmerized by this movie. Because it was such a hit, there was merchandising for it (man I wish I had half of what was out there back then) and my grandmother bought me one of the felt coloring posters that were popular. I wish I had that today. It had a key part of the movie in it so I won't describe it for those that have not seen the movie and have interest.

So through the years I'm watching this movie every time it's on television and finally it's released on VHS. I'm excited and ask my grandmother to buy it. She was going to get it for me until she saw the price tag: $89.95. Why was it so much? Well back in the 80's movies weren't just $20 or $30 as a given. They were actually much more expensive. It wasn't until the late 80's when movies went down. In fact, I believe Batman was the first movie released for a cheaper price, but I could be wrong. Anyhow, she wouldn't buy it for me (I was spoiled back then and pissed), so I had to rent it and record it. This was my copy of the movie for many years. I actually hadn't seen the movie for years until 2006 when I found out the movie was FINALLY being released on DVD. There was a catch: It wasn't being released in the United States. It was being released in Europe, Japan, etc..

I read reviews of the movie from these countries and immediately bought the one from Japan. It turns out that one was 'edited' with three minutes cut. I did find the German version in 2007. That one claimed NOTHING was cut. The movie was the full 106 minute unedited 2:35:1 version. I picked it up for about $35.00 shipped to Arizona, so that's not bad at all. Around the same time, I found out they were FINALLY releasing Convoy on DVD in the US!!! I couldn't believe it. That dream didn't last very long sadly, as some stupid company called "CheezyFlicks" released it. They *claimed* it was in its original 2:35:1 aspect ratio with full stereo sound (the movie was shot in mono in 1978), but it looks like someone copied a copy of a copy of a copy of a copy of a copy and the sound is atrocious!!! I don't understand HOW it was even released. There's pops and glitches, etc on it. It's in its 2:35:1 aspect ratio alright. Most-likely because someone took the Pan and Scan version and 'stretched' it, because that's exactly what it looks like sadly. Another company released it around the same time in a little better quality, but not much. My Kinowelt version (German) is fitted like it's supposed to be and for a 31 year old movie, it doesn't look bad. The sound isn't bad either. There are a couple of slight imperfections with sound as well as a few glitches with the transfer, however they're very minor and unless you're a perfectionist (which I am - LOL), you won't notice.

This sadly, is the best version there is to date and I'm happy to own it, but it still looks dated. Because of this, I ripped it to mpeg2 and 'attempted' to make it stereo and converted it to a region 1 dual layer DVD. It looks really good and does work on my players that are not region free, so I did something right. Besides, my wife was getting tired of seeing fifty versions of the movie on my computer as I just couldn't get it right.. Again, I'm a perfectionist. I did finally add more color and sharpen it. Took 11hrs to render, but it turned out the best and that's the copy I currently have. I actually thought that would be the best version of the movie I'd ever see.. BOY was I wrong:

I found out a month or so ago that MGM HD would be airing the movie in its entirety completely uncut. Well I checked their site immediately and found NOT a 106 minute cut, but a 111 minute cut?!! I figured that was probably a typo, but I'd never know for sure because COX (the provider I use) doesn't have MGM HD. It appears to only be on satellite from what I can tell. Well my buddy agreed to DVR it on satellite (Thank you!!) so I could see it. I was excited to see it, but I know it wouldn't the 2:35:1 aspect ratio and figured it would be stretched. Again BOY was I wrong. It was not only it its proper aspect ratio, but it REALLY was 111 minutes *and* it had scenes in it that I've NEVER seen. Where they got them I don't know, but I was very happy to see it like this. In fact color had been added to it and it looked MUCH better than the version I made. The sound was really good as well and I didn't notice any sound glitches. In fact I noticed sounds that were never there before. I badly want this version and I'm willing to take a bootleg of it if I have to. (I'M TALKING TO YOU MGM: It's about time to release a BD copy of this movie or lose out on fans either buying bootleg copies or downloading it or whatever). The movie is great and I really want to see it given its proper transfer on Bluray Disc.

Anyway, this was supposed to be about how much I like the movie yada yada, but I got caught up on the moment of that awesome transfer I saw the other day and I can't wait to see it again!!!

WHAT IS WRONG WITH ME?!!!!!!!!! *WHY* can't a pass a simple 40 question test?!

I keep studying and for WHAT?!!!! I'm just wasting money. EVERY test costs $125.00 and I have taken it THREE times now. That's $375.00!!! I really felt like I was ready this morning to take test number 3, but apparently not. Technically I've taken it FOUR times, however my second time in one of the simulators screwed up, so I was reimbursed for that one.

I've studied like crazy for this stupid thing and it doesn't seem to matter. I'm working on taking the ICND1 Exam (Interconnecting Cisco Networking Devices) as it's the first exam to my CCNA. I have basically two choices: I can pay $250.00 to take the whole exam (both ICND1 and ICND2) or pay $125.00 for each one. I have tried taking the first one SEVERAL times now with no luck, so I'm strongly considering paying the extra to take both, however right now we aren't exactly rolling in the dough, so I really don't know anymore.

Here's the kicker:

I do more advanced stuff every day in my job. The test is definitely hard because of memorization stuff, however the simulations are the big points. I really hate the fact that I have NO idea what I missed as Cisco does not actually tell you the questions you missed, but the category. The problem is there might be one question for a certain category and if you get it wrong then you get 0% for a score in that category. I'm having trouble with Cisco's site to get my previous exam scores, however below is my current for today, August 17th, 2009:

Describe the operation of data networks - 85%
Implement a small switched network - 37%
Implement an IP addressing scheme and IP services to meet network requirements for a small... - 55%
Implement a small routed network - 75%
Explain and select the appropriate administrative tasks required for a WLAN - 0%

Passing Score = 804
My Score = 748

I refuse to give up, but at the same time I feel like I'm letting my team down as well as myself. My wife tries to study with me, but she's frustrated too. I *NEED* to find something that will be similar to the test.

Confusion CAN Cause Issues

"Before I say anything, let me first say hello to Doug and Tanja and give a big hug and thank you for their congratulations. I've been really busy working on my CCNA, so I've not had a whole lot of time to do much, and that includes talking to friends from afar." Also, let me explain the below a little bit. I plan to write a long post regarding the below, however for now let me say that I'm a huge fan of the movie Convoy. I hate the song, HOWEVER the song in the movie is great. My lovely wife actually found the lyrics to it and before losing it I posted it here so I *had* it. On to the reason for this blog:

My wife is/was very upset at me both last night and today as I think there was confusion probably for both of us which in turn led to a fight and her sleeping in the other room. I'm going to paste her entire blog in this window and give my own answers to what is being said as I feel it needs to be put here, so please bear with me:

I do not mean that just because my air conditioner was fixed last week. I mean it was cold in my bedroom. We went to bed on opposite sides of the bed last night.

We did yell at each other a little bit last night because of money issues, so there was a little tension *but* I went to bed late last night (around 1:20 AM) and I figured she was asleep and I just wanted to get to bed as I had to get up at 6:00 AM or at least I was supposed to. Because of that reason I didn't cuddle with her. I moved as close to the fan (We sleep with a fan) as I could to fall asleep. With me that didn't happen anyway, as I kept resetting the alarm over and over again and didn't even leave this morning until 7:45 when I was supposed to be in class (I'm in class this week btw) by 8:30 AM. I made it, but barely. Thinking back, I should have cuddled with her as I deep down knew how she would have felt later.

After awhile I got cold and lonely and went and slept in our future sons room. I still felt the same but at least I knew the love of my life was not beside me making me feel that way.

I had no idea she was in the other room. I sleep like a rock. Having said that, I woke up no less than 10 times last night probably because she wasn't there, however I thought she was in the bathroom or something and I feel back asleep pretty quickly.

I don't know which stresses him out more, the fact that he could be fired if he does not pass this class, or that I am pregnant and not doing anything right.

I don't think I'll get fired if I don't pass the test anytime soon, but I receive flack DAILY from ALL of my co-workers about this test. A couple have offered to help me study, but most think they're better than me because they have certifications, and honestly, my boss has watched how others treat me and he really just wants me to pass so I can stop being the peer everyone hates. I won't comment on the "I can't do anything right" other than she knows I hate it when she says that and I do NOT, let me repeat: do NOT like it when she says that and puts herself down.

Though being pregnant is one of my fondest dreams.... I have prayed and wished on stars for this.

It is also something I have prayed and wished on the stars for as well.

But lately I have wished I had never gotten pregnant.

Please do not EVER say that again.

It has caused us to fight in ways we have never fought before. It scares me that he will walk out on me one of these days because my hormones are out of control and his blood sugar makes him have anger issues.

That is true. We do have more tension now, however it's because she's not the confrontational type with me typically, and with my blood sugar being high or low or who the hell knows anymore, that makes us clash much more often than before. She knows I won't walk out on her. I've NEVER felt that way, other than huge fights we have had in the past (I can think of two), but when I think about that I think "What am I going to do without her?!". I'd never go that far, no matter WHAT I've said in the past. I love her too much to even THINK of it normally.

Or because he will realize the baby is taking his freedom and my attention. Last week he was pulling at his hair and slamming his fist into the couch because I told him his blood sugar was dropping and he was turning stupid. Like I have for years. According to him that had always upset him.

I have mentioned it upsets me in the past. Having low blood sugar can literally KILL me. It hurts me more than anything because I do act stupid (blood no longer going to brain = idiot who can't think). My blood sugar has actually dropped during the tests I've taken, but I'm on a stupid timer and just have to miss one thing after another. That's one of the reasons I've never passed sadly as I can't think during the test, but that's a side thing. I will say it's low right now so I'm drinking orange juice.

Last night he didn't say a word to me when he came to bed and then he made sure he was as far from me as possible. I said good night and he still ignored me. Eventually I went and slept in the other room. For once he didn't join me. In fact he didn't even ask me where I was going. That is how I new he was fuming about our argument.

See above for the first part of this. I heard something and said "Hunh" or something, but she didn't hear me I guess. I figured she went to the bathroom and passed out shortly after that she left the bed. I was NOT fuming about our argument.

It all started with me pushing him to study. He has to pass this class for work or they will fire him. He started the classes on Monday and they end Friday. He is taking the test Monday. I am really stupid when trying to help study because I have no idea what I am reading. I can't help at all with simulators because it involves the computer. After I had finally got him in there to study, he told me to come in and figure out the bills. I didn't want him distracted from his studies but after his pushing I went it. Also cause he said he would help. I went in and tallied everything. I found out how much we got paid and then asked his opinion on how we should pay them so we have money for our vacation. That is where it all turned south. We both started yelling. I was upset cause he said he would help me pay bills and didn't, and he was upset because I asked him to pay the house payment. He then pushed his keyboard away from him pissed off and started canceling the vacation and telling me was going to get fired. I know he needs to study I am the one that is pushing him to do it. He is the one that wants to watch tv and go herping. I paid the crucial ones and left us with 500 for the 2 weeks.

They won't fire me I don't think, though I could be wrong. Please see above. I told her to pay the bills because I'm really stupid when it comes to that and she's really good at doing the math. I did get upset, however it was because I knew the vacation isn't going to work unless we pull from the baby's $600 that we have now. I really DON'T want to touch the baby fund. I try to pretend it isn't there other than the friggin' $900 I had to use from it a couple of weeks ago for the damned air conditioning. She is right about the watch tv and go herping thing though, but she left out fishing. Either way I procrastinate EVERYTHING and I always have unfortunately.

I am prepared for the baby fund to be tapped on our vacation. I have 600 in it. We have basically bled it with emergencies. Why not one last week of freedom before the baby comes. We both go on vacation the 22nd. Around midnight I eventually shut down my computer and left the room.

If she truly wants that I'll do it but *ONLY* because I have a bonus coming next month or the month after for on-call.

I figured all was fine when I decided to go to bed. I brought him both of his medications and prepared the alarms. I even made sure the bed was ready so he could just slide in and right up against me. At 1240 I told him he needed to come to bed it was getting late. He said in a minute he would. At 10 past 1 he finally came out of the room and went outside to have a smoke.

I needed a smoke. I had quit for a while, but you know how that goes.

At 125 he came into the bedroom. I had passed out waiting for him. I was laying in a position where he could just back up into me and go into auto spoon. In stead I felt the cats walk the empty space between us. After ten minutes I new he was still pissed at me and I went away.

Please see above. It's too bad though, auto spoon would have been nice. :\

It is now 235am. I am going to distress and go to bed in the babies room. At least I can sleep now. I good cry while typing works out really well.

That really upsets me. I honestly had NO idea. :(

Oh god I didn't sleep at all. When I wasn't trying to get comfy I was thinking about how mad he is at me. I found that out really quick.

Not true.

I set my alarm to get me up so I can make sure that he gets up too. He had reset his alarm for 15 more min. Instead of asking me why I wasn't in bed he asked me where the fuck were you. I answered with I couldn't sleep. So 15 min later I went in and got him up again. He had again reset the alarm and asked me why aren't you in bed? I told him I couldn't sleep. Each time I would crawl back into the futon bed in the babies room. Finally he got up and got ready.

I honestly don't remember any of that. The expletive I mean. I remember her waking me up, however I needed more sleep.

One way I knew he was stilled pissed off at me, was the fact that he didn't even come in to check on me or anything. He just got up, got dressed, didn't have breakfast, and left immediately. The garage door is right by the babies room. You have to pass it to get out. He didn't even say anything to me. He set the house alarm and walked out.

NOT True! I got up, got dressed, sat on the couch in the living room and played with my IPhone for a little while. I walked into the hallway and looked in on her and her eyes were closed. I then set the alarm and went back and looked at her and her eyes were closed still, so I tried not to make noise and left as I was running late.

I must have really did him good last night to make him hate me so much that he won't even talk to me. Any other day he would have gotten up and looked for me this morning. He would have been concerned that I was not in bed. He would have talked to me.

Well it is 817am I need to get ready for work. I know he won't contact me all day so I have to wait this out and see how long it takes him to calm down and talk to me. Now to figured out if I want to be upset tonight and have the baby stress out or stay away and see if he contacts me.

It is going to be a lovely day at work.

I've talked to her and I hope everything is ok now. Like I said, this is a tale of confusion. Her birthday was last week and I spent a lot of money on her, so I really have myself to blame for money troubles, but DAMNIT she's the love of my life and she DESERVES everything she gets. \

The Summer Heat Has Arrived

My wife, the animals, and I have all experienced it firsthand. Last night I came home from work and found the house at a cool 90 degrees farenheit. I had no choice, but to get an emergency visit from an A/C guy last night. Almost $900 later, the fan motor had been replaced and the house was starting to cool off. :(

Sadly, that was our baby fund and while I'm thankful we even had it, it's still one of those things that shouldn't have happened. Last year I had the unit serviced in April and the guy said "It's in great condition! You shouldn't have to worry for years!". I wish I would have used my gut instinct and had the A/C checked this year. You see, right now Phoenix is in the middle of an "EXCESSIVE HEAT WARNING". What does that mean? It means we're hitting temperatures in the MINIMUM of 112 degrees daily, and with a pregnant wife, 3 cats, several reptiles, and a tarantula, that's not a good thing.

I am lucky I didn't come home to all of our cats dead. It was 94 degrees by the time Roxanne got home last night. Either way, it sucked.

As to be expected, Microsoft responded to news today that Windows 7 activation had already been cracked by telling Betanews that customers should not pirate the operating system. But the company also said it was happy to hear that people wanted to install Windows 7.

Following the publication of an activation crack for Windows 7 mere days after it was released to manufacturing, we contacted Microsoft to hear its take on the issue, which appears to be a repeat of the Windows Vista crack from 2006. Windows XP activation was also cracked not long after its launch.

"Microsoft strongly advises customers not to download Windows 7 from unauthorized sources. Downloading Windows 7 from peer-to-peer Web sites is piracy, and exposes users to increased risks -- such as viruses, Trojans and other malware and malicious code -- that usually accompany counterfeit software. These risks can seriously harm or permanently destroy data and often expose users to identity theft and other criminal schemes," the company told us.

Nonetheless, Microsoft actually seemed flattered by the crack, a surprising admission that probably has more to do with making Windows desirable again than piracy.

"We're pleased that customers are eager to begin using Windows 7!" a Microsoft spokesperson added.

Decades ago, the anecdotes go, Microsoft actually liked people pirating Windows, because it helped spread the operating system and eventually establish its dominance across the PC market. It may be "strongly advising" people not to pirate Windows 7, but it's clear the company desperately wants customers to want the upgrade.

Is this a sign of lowered expectations after Vista's painful launch, which was delayed by more than nine months and then saw only a lukewarm reception?

Can't use MMS on an Iphone 3GS?! No problem! Use email!

Geez.. why didn't I think of that?! Oh wait.. I know: BECAUSE IT'S IDIOTIC!!! The Iphone 3GS has MMS capabilities right out of the box. AT&T just refuses to support it. I just read this on a website from a supposed AT&T Customer Service Representative and basically had to laugh:

I think it’s pretty sad that my wife who’s using a Motorola Razr is able to send/receive MMS all day long, however my brand spanking new 3GS that *SUPPORTS* MMS doesn’t work on ATT’s network. MMS is one of the main reasons why I bought a 3GS. In fact, she laughs at me all the time about it.. :P

So I basically have a phone that browses the web, sends email, takes pictures, takes videos, plays games, but I *can't* send an MMS?!!! If you are unsure of what that means, there are basically two types of sending services via a cellphone:

SMS: Short Messaging Service (works fine)

MMS: Multimedia Messaging Service (does not work)

Anybody that knows me called me "Herper Dave" or "Herper" or "That Snake Guy" or whatever. I was simply making a joke that any child Roxanne and I have will be some sort of reptile because I'm so into them. Having said that, boy or girl, they WILL learn what reptiles are and will some day join daddy (I love that!) on excersions in the desert or whatnot looking for the "notorious" Arizona MilkSnake or Green Ratsnake or whatever.

I'm sure the first thing on anyone's mind from looking above would have to be "What's With the Babies?!". Well I'm getting ready is all. I am overjoyed to announce something I thought I would *NEVER* be able to tell anyone. And yes you guessed it: Roxanne and I are having a baby. :-)

Ok, technically SHE'LL be having the baby, but I helped make it happen, so I guess that means WE'LL be having the baby, so there! Anyway.. I had to keep this a secret for TWO MONTHS which for me is IMPOSSIBLE. We let everyone know at a dinner on May 23rd, 2009. I thank everyone that was able to attend. Those that did not, well you know who you are. This is the picture we handed out to everyone on that day:

That picture there was when she was 11wks along and the baby was 11" we're told. Now she's almost in her 16th or 17th week and things are certainly changing.

Speaking of changing, I'll bet our lives are certainly gonna change. It will all be for the better of course, but it will be changing. We're hoping for a girl, but a boy would be fine too. Then again, coming from me, it will be a baby all right, but will probably look like so:

Ok, so the truck is back and I need to get it paid off. My wife's boss sucks.. Nuff said about that. Ummmmm, I'm working right now, but will be leaving soon. I need to study on Sunday as I'm support to take my Cisco Certification Exam, however the truck issue has bled both of us dry on money.

I will be making more skits tomorrow most-likely, so stay tuned here for direct links to them. I guess that's really about it at this point. Oh yeah, hoping to do a quick herping trip tonight for the hell of it.

Transmission Issues - Part 2

Ok, so it is going to cost me over $2000.00 unfortunately to fix the transmission in my truck. The gentleman gave me a breakdown which is greek to me:

1. Apparently my pump is failing, so that will need a replacement.
2. My Torque Converter might be bad, so they need to resolve that issue.
3. My Shift Selenoid Block is the biggest problem. Apparently that's the reason for the "check engine" light.

He also mentioned something about metal shavings spraying into the transmission which apparently isn't good. I've asked for a loan from the company I work for, however that probably won't happen, so I might need to get an advance on my paycheck.

I'll get through this, it just might take some time. We'll be doing taxes tomorrow, so hopefully that will help out as my wife needs to get her motor mounts replaced on her engine.

Transmission Issues - BIG $$$ I don't have.. :-(

So it was bound to happen eventually. On Saturday, the truck decided to flash me the notorious "check engine" light we all know and love. I took it into AutoZone to run a quick diagnostic check and found there was an issue with the transmission. Hoping that is not the case, I went ahead and took it to another AutoZone (it was 8pm and most places were closed) and receive the same results:

P0700 and P1776

Both tell me the Transmission component may be slipping..

So now I basically have two choices:

1. I can take it to a transmission shop
2. I can *hope* it will just work

I chose option number one. Found out it will cost a minimum of $1350.00, which I don't even have. Many things will be replaced in this price, so hopefully that fixes it. The only redemption I have, is that the shop I took it to is willing to take payments, so I at least have that.

So now I'm waiting to see how much my truck is actually going to cost in repairs. I'm praying it's not that bad. Thanks for reading..

Dumb Criminal Award to Cable One arsonist?

Hansel and Gretel left a trail of bread crumbs to find their way out of the forest. Greg, Bobby and Peter Brady left a trail of popcorn as an escape route from a Hawaiian archeologist bent on holding them captive.

     In Show Low, however, criminals simply leave deep footprints in the snow as a guide, not for their escape, but to make it easier for law enforcement to track them down.

     It may sound strange, and one can only assume it was not intentional, but that is exactly what happened when the Cable One technical operations center in Show Low was vandalized and set afire.

     Such actions compel us to question whether this was simply a dumb criminal trick or perhaps a dress rehearsal for an attempt at the ever-popular and much coveted Darwin Awards given posthumously to people who give their last full measure of devotion in convoluted but nonetheless successful attempts to remove their faulty genes from the pool.

     To be fair, perhaps whoever set the fire counted on the heat from the flames melting their telltale footprints, or maybe they simply thought police would think the prints were left by a Sasquatch and would look no further.

     Or maybe with the current economic crunch and the high price of heating fuel they had a dual purpose in setting the fire in hopes that the intense flames would heat their home and provide a venue to cook meals and roast marshmallows at no cost to themselves.

     The good news in all of this (albeit only for whomever is ultimately held responsible) is that since the ATF became involved there is the possibility that the perpetrator could face federal incarceration, which is tantamount to a paid vacation.

     Again to be completely fair, maybe that was the purpose, to secure free room and board along with cable television and Internet service at the expense of those of us who misguidedly obey the law while also looking towards longevity and health and burn firewood rather than polyvinyl chloride.

     While PVC does produce more heat than wood or heating fuel, The Independent would like to offer a little sage advice about the toxic effects of inhaling such poisonous fumes and soot. Just say no!

     But maybe that advice is premature and unwanted. It is just possible that the person responsible for the arson fire was actually thinking of the community as a whole and theorized that this might be the best way someone of limited mental faculties could aid the failing economy.

     Perhaps they felt their actions could provide a little job security for law enforcement during these trouble times by giving them something extra to investigate.

     The problem is that they left footprints, which only garnered Show Low Police and agents with ATF a finite number of hours expended on the investigation and subsequent arrest of a suspect who is at this moment in the Navajo County Jail.

     Nonetheless we would like to offer the responsible individual this one-time "Dumb Criminal Award" as acknowledgement not so much for their misguided behavior, but as a thank you for providing The Independent the fodder to write this editorial.

     As an apropos addendum and all joking aside, it is never a good idea to break the law.

     Setting fire to a structure sometimes ends with a loss of life, either the occupants or the brave firefighters who battle the flames, and in the end potential criminals need to be aware that ultimately the long arm of the law will find them, so the key phrase in this editorial is to just say no!

Police make arrest in Cable One arson fire

SHOW LOW - Police made an arrest in connection with the Cable One arson fire on Tuesday, Feb. 10.

     The arson caused an estimated $1 million in damages, according to Cable One. A press release from Show Low Police reported that Richard Steinmetz, 32, of Show Low was arrested after officers served a search warrant on a home in the 1600 block of N. 6th Street at approximately 4 p.m.

     Steinmetz was booked into the Navajo County Jail and is currently awaiting filing of formal charges against him with the Navajo County Attorney's Office in connection with the arson fire.

     Show Low Officer Rodney Hall was the first to arrive at the Cable One technical operations center at 1341 E. Thornton after a call to the dispatch center at 1:41 a.m. Show Low fire also responded.

     "After officer Hall's report of an actual fire, the response was upgraded to a first alarm for the Show Low Fire Department," read the Feb. 12 press release.

     Police found fresh footprints in the snow which indicated someone had recently been at the scene. The footprints led to a broken window where the fire was visible by Hall.

     Show Low firefighters were able to quickly control the fire but not before fire and soot damaged equipment to the extent that about 12,000 customers were left without some cable services.

     Agents with the Bureau of Alcohol, Tobacco and Firearms also went to the scene to investigate on the federal level. Representatives with Cable One said that the ATF investigation has been concluded and shortly afterward Cable One technicians began restoring most services to affected customers.

     Show Low Det. Jason Spears said the investigation is still ongoing.

Happy (Late) Valentine's Day 2009

So another Valentine's Day has come and gone. My wife had something planned for me as usual. She took many pictures and her friend Devor had them printed out and put in a nice frame. In fact, she had two sets done in nice frames. Roxanne also got a new tattoo. It's a gecko with the name "David" printed on it. I really like it, but I told her I'd rather she not get any more.

I got her a plush heart that says "Love Ya" on it, plus a plush dog or something inside a balloon with a chocolate bar, plus a very large stuffed teddy bear, plus a dozen roses. I would have liked to do more, but I just had gotten my new credit/debit card on Friday, and was forced to shop at Walmart around 3:00 AM after the movie I saw (see below), so there wasn't much of a choice unfortunately.

So we both went to Red Lobster last night for dinner. I knew right away that would be $100.00 gone, but it was Valentine's Day and worth it. Plus one of the waitresses tripped near us and we got to see this guy get covered in freezing cold ice-water, so that was priceless. hehe

I would put more in, but I promised my buddy I'd help him install Vista 64 Bit, so I gotta go!

Friday the 13th (the movie), February 13th, 2009

So I'm a pretty big Jason fan. I'm not as big of a fan as my buddy, but I do like Jason Voorhees none-the-less. It was no surprise that I wanted to see the movie when I heard they were remaking it. Plus Jared Padalecki is in it, and I enjoy watching him as the brother "Sam" on the TV show Supernatural. The trailers made the movie look like it was worth watching, however I should have known that since it was made by the same person that made the remake of "The Texas Chainsaw Massacre" that it was going to be similar, however we'll get to that in a little while.

Ok, so my brother-in-law Keifer and I went to see the movie after I got off work last night. We went to a very nice theater called the Harkins Cine Capri mostly because I knew with it being opening weekend (or in this case night) and being right next to Arizona State University that there would be idiots in the theater. I could not have been more right sadly, but we'll get to that in a little while as well. So here we are in the theater after getting food and drinks and getting ready to watch the movie. It was EXTREMELY loud in the theater as it was a sold out auditorium and this thing holds 600 people or so!!! Anyway, so because of this, we are forced to sit in the second row in order to get a seat before it was too crammed to even sit down. This made it very difficult to watch the screen, because you were looking up the whole time. Not to mention right to left and left to right in order to see what was going on, so that alone made me almost call it quits. I actually pushed on and decided to give it a chance.

The morons in the theater would NOT shut up!!! There were scenes in the movie that were supposed to be jump scenes or adrenaline pumping, and all I hear is "YEAH!!! THAT'S MY BOY!!! GO JASON!!! THAT'S MY NI**A!!!!" That and listening to all the dumbsh*ts that were talking the WHOLE time was the last straw, so we left. After getting passes to another Harkins, Keifer tells me that we tried and he didn't wanna try again. I told him I wanted to, so I left and was basically on a quest at this point. I was GOING to see that movie sometime during Friday the 13th. As it turns out, I didn't end up seeing it on the 13th, but instead on the 14th. *sigh*

So my phone dies and I have to rush to work to charge it, because I forgot to put a charger in the truck. So here I am charging it, and I'm trying to talk my buddy Roth into going to the movie, but he's like, "I'm not interested in that stuff" but he quickly changed his mind, when I said I would pay his way to get in. Heh

He even brought his wife (and also a friend of mine) Devor, so that was cool. Roxanne couldn't come unfortunately, as she had to work the next day. *Sad*

Anyway, it didn't turn out anything like I'd expected, which of course was a bit disappointment to me, 'specially since I essentially saw the movie twice in one night. Well at least 20mins of it was seen twice. So here's a synopsis or therefore a review of the movie:

The movie begins with a girl in a t-shirt running away from someone in the rain at night in the woods. It turns out the person she was running from is Jason's mother Mrs. Voorhees. The original movie explained that she killed all of the counselors because they were having sex and drinking and basically ignored this deformed kid drowning in the lake. Today's story doesn't explain that (unless you watch the trailer) so you pretty much have to put it together. Without giving the movie away, kids get killed and about 20mins into the film you see the title "Friday the 13th".

I was disappointed with this Jason because the original Jason had charisma and hid in the shadows for the most-part until he was ready to pounce on some unsuspecting naked girl or boy, but this one was basically out there in plain site, so you'd have to be a moron not to notice this 9ft hulking figure running around the woods. Plus the original Jason was bald like below:

The new Jason has long hair basically and it just doesn't look right to me:

In the original Friday movies, Jason takes the hockey mask from a kid who likes to pretend he's a horror actor and scare others, but this Jason just randomly finds the hockey mask on the ground in a room under some debris. What is that? Plus the originals had Jason basically going after camp counselors (not always though). This first installment has him going after anybody randomly that gets in his way. So I didn't hate it, but I didn't love it, and that's the sad part.

I'm sure I will watch it again and maybe without the distractions I'll enjoy it, but so far the Jason Voorhees of 2009 just doesn't do it for me. Oh before I forget:

The most disappointing thing was that the originals had the "Chi chi chi" "ha ha ha" every time Jason went to make a kill. This movie had that maybe three times in the entire film. The soundtrack was phenomenal though. I don't mean music-wise, but the sounds of Jason jumping and general noises overall in the movie were excellent I thought.

If you're into the horror genre like I am I recommend watching it, but if you're a big Jason Voorhees fan you may not like it as much as you think.

Suspected Vandalism and Arson Cause Cable TV Outage

Suspected vandalism and arson left the Cable ONE technical operations center in Show Low extensively damaged.

     The twelve satellite antennas that bring in cable signals for the area, including Winslow and Holbrook were all damaged.
      Customers in Winslow and Holbrook are temporarily without cable reception. Cable ONE Phone and High-Speed Internet service appear to be operating normally. Melanie Stroupe, spokesperson for CableOne indicated that approximately 12,000 customers in the White Mountain area are currently affected by the outage.

     The Winslow office remains open for business and field technicians will continue to keep all scheduled appointments today and throughout the week. A possible attempt to torch the building has also left the office with extensive smoke and soot damage. In the interim, the local office will be closed until it is safe for associates to return to the building. Telephone calls to the office will be routed to the Cable ONE call center in Phoenix.
It is unknown when Cable ONE can access the equipment to evaluate the damage and restore service.

    The police investigated early today and The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) will be at the Show Low site this afternoon conducting an investigation. After the ATF finishes its investigation, Cable ONE can begin repairs and plan to use every possible resource to restore cable TV service quickly.

VISA Credit/Debit Card Numbers Stolen

So I've been contemplating writing this for some time, however it puts a bad taste in my mouth thinking about it. Maybe talking about it here will make me feel better? Dunno.

So last week sometime (or the week before.. not sure), my wife noticed a charge in our bank account that said MAKEMONEYONLINE for $50.00. She asked why I would buy something like that, and I told her I hadn't.

After some investigation, it appears someone used my name and CC # to purchase this product. They did create a Gmail account to do it, but Gmail is no help, and practically nobody will help me, so I'm basically out $50.00.

I had the card cancelled and we're waiting for a replacement, but I'm pretty upset about the whole thing.

All I can say is this:

If I ever find out who you are, I will hunt you down like the you are!!!!!!

- 1/5/09 - crash with furniture truck. "A Metro light rail train broadsided a white pickup truck filled with furniture Monday afternoon in Tempe's first train accident since the system began operating a week and a half ago."

- 12/30/09 - crash with car. "A light rail train full of passengers collided with a car in downtown Phoenix Tuesday afternoon, marking another first for the new transit system."

30-second porn interruption during the Super Bowl.

Philadelphia-based Comcast issued a brief statement Monday saying the company is

Sheriff's Office to transport inmates via light rail

Maricopa County sheriff's deputies may soon begin taking some inmates to Fourth Avenue Jail on Metro light rail in a bid to cut costs.

Sheriff Joe Arpaio's decision caught Metro Light Rail officials by surprise, but a spokeswoman said transporting inmates on the train does not violate light rail ordinances.

"This is not the intended use of the system and Metro objects on the basis of the potential concern it may create for our passengers," Metro Light Rail spokeswoman, Hillary Foose, said. According to Foose, Metro Light Rail wants to ensure the safety of the 20,000 to 30,000 passengers that ride the light rail each day.

"Anything that concerns our passengers, or has the potential to concern our passengers, concerns Metro Light Rail," Foose said.

Arpaio said he planned to transport inmates using the light rail from 44th and Washington streets to the Fourth Avenue Jail in order to eliminate parking fees. MCSO estimates that the new system can save about $72,000 in transport fees.

The stop Arpaio designated is the one commuters use to access Phoenix Sky Harbor International Airport.

The Sheriff's Office announced the new arrangement Tuesday afternoon, but did not specify what kind of inmates will be transported or how many may be moved at a time.

The agency will release more details at a 5 p.m. news conference,

"There is nothing to be concerned or worried about as my deputies will be armed," Sheriff Joe Arpaio said in a press release.

The inmates are not required to be separated from other commuters but Metro Light Rail is concerned that passengers may still object to the new arrangement and fear for their safety, according to Foose.

"We are expecting them to be responsible for their inmate; the security of the inmate and those around the inmate is the responsibility of the Maricopa County Sheriff's Office," said Foose.

As a public transportation system, Metro Light Rail, ordinances allow anyone who pays proper fare and abides by the rules to ride the light rail. The ordinances also allow passengers to carry concealed weapons with valid licenses.

Apparently BOTH of us went over our minutes. I went over more, but my FUCKING MOTHER DIED!!!!!! I was on the phone a lot! That doesn't matter to anyone though. "You need to pay us or we'll shut you off". "SHUT ME OFF THEN!!!!" This is bullshit.

Sorry for my rant, but AT&T can go fuck themselves. I'm on the phone with a lady right now. "It's not up to us to watch your minutes sir. You went over and are responsible for paying your bill. Let me get you on another plan that is more expensive with more minutes, but we'll knock off $200.00 as a *one time only thing* that should help with your bill".

So now instead of the $145.00 we usually pay, the bill will be almost $200 a month. That's IF we don't go over our minutes again. You know who's looking good right about now?!

Windows 7 Beta Released Today

So the beta of Windows 7 was released today (20090109), however if you were lucky enough to get a product key for it consider yourself one of the lucky ones. I downloaded the operating system several hours ago, however the site https://www.microsoft.com/betaexperience/productkeys/win7-32/enus/default.aspx is constantly saying "The site is currently experiencing technical difficulties, please check back in the next business day.".

Two issues with that: (1) Today is Friday, so the next business day won't be for a few days, and (2) Microsoft is ONLY giving product keys out to the first 2.5 million people that can get in and snag a key. You must have a Windows Live logon or something and can use http://profile.microsoft.com to sign on. Once you do that, open a new tab and put in the URL above. Keep hitting refresh and hopefully you'll get a key. I've been trying for hours sadly. :-(

As I would buy it from Best Buy most-likely, I'd prolly spend almost $4000 or $4500 with accessories, so ummmmmm I'll either wait, or win the lottery before I buy this thing. So I *want* it, I just can't have it.

Those that are familiar, may know already, but Lloyd Levin (One of the actual producers of this movie) has released an open letter to the internet written by him in order to give some perspective on what is happening. An open letter.

Who is right? In the Watchmen dispute between Warner Brothers and Fox thatquestion is being discussed, analyzed, argued, tried and ruled on in a court of law. That's one way to answer the question - It is a fallback position in our society for parties in conflict to resolve disputesAnd there are teams of lawyers and a highly regarded Federal Judge trying to do just that, which obviates any contribution I could make towards answering the "who is right" question within a legal context. But after 15 plus years of involvement in the project, and a decade more than that working in the movie business, I have another perspective, a personal perspective that I believe important to have on the public record.

No one is more keenly aware of the irony of this dispute than Larry Gordon and I who have been trying to get this movie made for many years. There's a list of people who have rejected the viability of a movie based on Alan Moore and Dave Gibbon's classic graphic novel that reads like a who's who of Hollywood.
We've been told the graphic novel is unfilmable.

After 9/11 some felt the story's themes were too close to reality ever to be palatable to a mainstream audience. There were those who considered the project but who wished it were somehow different: Could it be a buddy movie, or a team-up movie or could it focus on one main character; did it have to be so dark; did so many people have to die; could it be stripped of its flashback structure; could storylines be eliminated; could new storylines be invented; did it have to be so long; could the blue guy put clothes on... The list of dissatisfactions for what Watchmen is was as endless as the list of suggestions to make it something it never was.

Also endless are the list of studio rejections we accrued over the years. Larry and I developed screenplays at five different studios. We had two false starts in production on the movie. We were involved with prominent and commercial directors. Big name stars were interested. In one instance hundreds of people were employed, sets were being built - An A-list director and top artists in the industry were given their walking papers when the studio financing the movie lost faith. After all these years of rejection, this is the same project, the same movie, over which two studios are now spending millions of dollars contesting ownership. Irony indeed, and then some.

Through the years, inverse of the lack of studio faith has been the passionate belief by many many individuals - movie professionals who were also passionate fans of the graphic novel - who, yes, wanted to work on the film, but more for reasons of just wanting to see the movie get made, to see this movie get made and made right, donated their time and talent to help push the film forward: Writers gave us free screenplay drafts; conceptual art was supplied by illustrators, tests were performed gratis by highly respected actors and helped along and put together by editors, designers, prop makers and vfx artists; we were the recipients of donated studio and work space, lighting and camera equipment. Another irony, given the commercial stakes implied by the pitched legal dispute between Fox and Warners, is that for years Watchmen has been a project that has survived on the fumes of whatever could be begged, borrowed and stolen - A charity case for all intents and purposes. None of that effort, none of that passion and emotional involvement, is considered in the framework of this legal dispute. From my point of view, the flashpoint of this dispute, came in late spring of 2005. Both Fox and Warner Brothers were offered the chance to make Watchmen. They were submitted the same package, at the same time. It included a cover letter describing the project and its history, budget information, a screenplay, the graphic novel, and it made mention that a top director was involved.

And it's at this point, where the response from both parties could not have been more radically different.
The response we got from Fox was a flat "pass." That's it. An internal Fox email documents that executives there felt the script was one of the most unintelligible pieces of shit they had read in years. Conversely, Warner Brothers called us after having read the script and said they were interested in the movie - yes, they were unsure of the screenplay, and had many questions, but wanted to set a meeting to discuss the project, which they promptly did. Did anyone at Fox ask to meet on the movie? No. Did anyone at Fox express any interest in the movie? No. Express even the slightest interest in the movie? Or the graphic novel? No.

From there, the executives at Warner Brothers, who weren't yet completely comfortable with the movie, made a deal to acquire the movie rights and we all started to creatively explore the possibility of making Watchmen. We discussed creative approaches and started offering the movie to directors, our former director having moved on by then. After a few director submissions, Zack Snyder came onboard, well before the release of his movie 300. In fact, well before its completion. This was a gut, creative call by Larry, me and the studio... Zack didn't have a huge commercial track record, yet we all felt he was the right guy for the movie.

Warner Brothers continued to support, both financially and creatively, the development of the movie. And eventually, after over a year of work, they agreed to make the film, based on a script that, for what it's worth, was by and large very similar to the one Fox initially read and deemed an unintelligible piece of shit. Now here's the part that has to be fully appreciated, if for nothing more than providing insight into producing movies in Hollywood: The Watchmen script was way above the norm in length, near 150 pages, meaning the film could clock in at close to 3 hours, the movie would not only be R rated but a hard R - for graphic violence and explicit sex - would feature no stars, and had a budget north of $100M. We also asked Warner Brothers to support an additional 1 to 1.5 hours of content incurring additional cost that would tie in with the movie but only be featured in DVD iterations of the film. Warners supported the whole package and I cannot begin to emphasize how ballsy and unprecedented a move this was on the part of a major Hollywood studio. Unheard of. And would another studio in Hollywood, let alone a studio that didn't show one shred of interest in the movie, not one, have taken such a risk? Would they ever have made such a commitment, a commitment to a film that defied all conventional wisdom?

Only the executives at Fox can answer that question. But if they were to be honest, their answer would have to be "No." Shouldn't Warner Brothers be entitled to the spoils - if any -- of the risk they took in supporting and making Watchmen? Should Fox have any claim on something they could have had but chose to neither support nor show any interest in?

Look at it another way... One reason the movie was made was because Warner Brothers spent the time, effort and money to engage with and develop the project. If Watchmen was at Fox the decision to make the movie would never have been made because there was no interest in moving forward with the project.
Does a film studio have the right to stand in the way of an artistic endeavor and determine that it shouldn't exist? If the project had been sequestered at Fox, if Fox had any say in the matter, Watchmen simply wouldn't exist today, and there would be no film for Fox to lay claim on. It seems beyond cynical for the studio to claim ownership at this point.

Today was a very hard day for all involved. My mother's ashes were buried. There was a lot of family there and many emotions. I hope this will once and for all offer closure to our entire family. A special thank you goes out to my Aunt Kimmy for putting everything together. It was a beautiful service.

Now to explain the whole situation:

My mother was buried today in Dewey, AZ and the funeral was to start promptly at 2:00 PM, however Aunt Kimmy was late due to severe traffic. The cemetery manager then wanted to charge an astronomical $115.00 because she was going to be twenty minutes late. I never did find out if that went through, but I hope not, because Kimmy was not at fault and therefore should not have to pay. Either way, on with the story....

So the pastor gets there and says a few words from the bible and some beautiful things were said. I don't recall what was said, but they were beautiful. Then Macy provides a writing that was really nice. Then Haley has something that she has written to mom and it was privately laid underneath the granite container my mom's ashes were now in, so I have no idea what she wrote, but I'm sure it was from the heart and also wonderful. I hope my mother gets to read it soon. :-)

Now Dewey is actually an hour and a half drive from Phoenix, so we needed our rest the night before to drive up. Unfortunately that was not in the cards as I was trying to drown any sorrows in alcohol, and Roxy, Darvin, and Kishie joined me, so we made it a Monopoly night. Yeah, we didn't get to bed until the wee hours of the morning, so I was really tired when I drove up this morning.

Either way, we went to Golden Corral afterward for dinner, and some of my friends showed up as well, so that was a nice surprise:

So I'm still in touch with Mr. Rose. I've asked him him and his wife would be willing to sign a certified document if needed in order to bring this to light. That is still pending as I have yet to hear back, but I'm sure they want justice as much as I and my family do, so hopefully the answer will be yes if I decide to pursue that avenue.

I have a lot of emotions from this. Do I pursue legal recourse against the driver that hit her? Was the driver intoxicated? I went by what was printed in the news article and made the assumption there were no issues:

"The driver was not found to be speeding or under the influence of alcohol or other substances"

If that is true, then WHY would a witness who actually SAW everything that happened tell me the driver was speeding past them like they were standing still WHILE they themselves were driving 70mph?! Was this "driver" a friend of the California Highway Patrol? Were they somebody famous trying not to be seen?! These are questions I'm going to keep asking until I get answers!!! MY MOTHER IS DEAD. NOTHING is going to change that. I want justice. That driver needs to answer for their actions. I don't care if they get a speeding ticket, but they need to ANSWER for what they've done!

I'm so frustrated right now that there's nothing I can do. She had NO business being on the damned freeway in the first place, BUT the driver that hit her had no business going felony speeds. I'm so upset right now. I try to be strong for everyone, but it's difficult.

It was very horrific what happened and the thought of all of it makes me sick to my stomach. I can't work, I can't sleep, I can't think of anything else right now. I wish it could be easier, but it can't.

My name is David and you apparently witnessed my mother's fatal collision. Nobody is able to give me a straight answer as to what happened on Friday night and it's been very hard on the family. My mother was not stupid and would never have crossed a busy freeway in the middle of of the night without a reason.

If you did see this accident, please provide as much information as you can. That will help me to piece this whole mess together, as I'm the oldest son and I am in charge.

I'm truly sorry for your loss. My prayers are with you. I can tell you what i witnessed. My wife and i just got on the freeway when the Range Rover flew past us... Mind you we were going 70mph and the SUV made us look like we were standing still. I would say somewhere in the 95-100mph plus range.
That's why i continued to watch the SUV. A few seconds later i saw your mother run across the road. That's when she was struck. i didn't see brake lights or anything.

We pulled over immediately and called 911. I cant tell you why she would have been crossing the road as I didn't see any cars in the median, but i can tell you that if that SUV had not been speeding this probably would not have happened.

I'm sorry to be so to the point but that is what i saw. My wife and I are very upset to read that the driver of the SUV isn't being charged with anything.

Thank you Mr. Rose. I appreciate you being straight and to the point. The CHP told me nobody was speeding and that she was in the wrong place at the wrong time. It's difficult for me to ask this, but I have to know:

When this SUV struck my mother going 95 to 100mph, did they stop immediately or keep going and then stop? What about the other vehicles on the highway? Did they stop or were you able to tell?

I know this must be difficult for you and your wife as it is for me to ask, but I am still trying to understand why my mother was on the freeway in the first place.

I am very upset that this SUV received no charges if you clearly saw them speeding. This could have been avoided from what you're telling me and that really upsets me.

The worst part, is that I need to tell my family the tragic news that the SUV was actually speeding and that my mother probably would have made it if it hadn't been for that unfortunate occurrence.

I would very much like to speak with you on the phone regarding this if you're willing to. If not, I can certainly understand, but thank you for getting back to me and for being there to call 911 and avoid what could have been even worse.

OAKLAND: CORONER IDENTIFIES PEDESTRIAN KILLED ON I-880
OAKLAND (BCN)

The Alameda County coroner's bureau has identified 52-year-old Cynthia Rutgers as the pedestrian who was fatally struck Friday night on Interstate Highway 880 in Oakland. The collision was reported around 11:15 p.m. just north of Hegenberger Road, according to the California Highway Patrol.

Rutgers was apparently running across the northbound lanes, from the shoulder of the highway toward the center divide, when she was hit by a silver sport utility vehicle, CHP Sgt. Sheri Jones said. She was pronounced dead at the scene. The driver of the sport utility vehicle stopped after striking Rutgers. Anyone with more information on the case is asked to call the CHP at (510) 450-3821.

This does not sound like my mother, and I hope to hear more in the near future. WHY was she running across a freeway? A Very Sad Day

I've had a very bad day. Chinese Democracy was released and I thought it couldn't get any better, then my truck got stuck and I had to be pushed out, then my wife's car broke down, THEN I got a call from a Sheriff's Office in Oakland, California that was urgent.

It turns out my mother was killed on Friday night.

All lanes were closed while the CHP investigated the incident, which was reported at 11:15 p.m. Spokesman Sam Morgan said Saturday evening that the victim was a Caucasian woman in her late 40s or early 50s, who was carrying no identification. The coroner's office had not yet identified her.

A 23-year-old man from Salida, driving a Range Rover, hit the woman in the third lane from the right-hand shoulder, as she was running toward the center divide, Morgan said. The driver was not found to be speeding or under the influence of alcohol or other substances, Morgan added.

So my buddy Jim got me into fishing. It's actually as much fun as herping now. Remind me to smack him! LOL.

Haven't been doing that great in the past few weeks, but that all changed today. We both caught large-mouthed bass, crappie, and carp. I actually caught a HUGE crappie and two of the bass were good sized.

Chinese Democracy LEAKED

Well that didn't take long. It's been what, maybe 5 days since the original announcement CD was going to be released?! Now we have final versions of the songs from the album leaked today? I can't believe some people. They wait years and years and years for this album to be released, only to almost ruin it by listening to leaks and demos (me included). Now the album is going to finally come out and three weeks before the release date we have full leaks of songs from the album?!

It gets better than that. Are they good leaks? No, they're copies from the album. The album is copyright protected and the dumbass that copied it didn't realize that, so the songs all have watermarks in them, which just happen to amount to digital skipping. So now everyone's talking about this song and that song, but complaining about how it doesn't sound as good because of skipping?!

WAIT UNTIL NOVEMBER 23RD PEOPLE. IT'S THREE FRIGGIN' WEEKS AWAY!!!!!!

Having said that, I will not listen to the leaks (or good quality full versions of the album) and will be waiting. Does that mean I won't get these leaks or quality versions of the album before it's released? No. I will still get them and just sit on them. When the album is released and I can hear it for the first time flawlessly and LOSSLESS, then and only *then* will I actually listen to the shitty quality versions of the songs. Because at that point, I will have a good laugh. The same way I'm having a good laugh at all of the jackasses that are bitching and moaning about how the songs are skipping and unlistenable.

Do yourselves a favor and buy the damn thing when it comes out!

"Chinese Democracy" is COMING

Ok, so it's not *real* chinese democracy, but the long-awaited Guns N' Roses album I've waited over a decade for is FINALLY going to be released. Sure I've heard several leaks and demos through the years, but none of them have been fully mixed or lossless copies. That alone makes me wish the release date was here or at least closer... Lossless versions of new Guns N' Roses!!!!

Before you say it's not Guns N' Roses, it's Axl's new band, keep in mind while Slash and Duff and Izzy, etc are not in the band anymore, the new band has been together longer than the original Guns N' Roses. Think about it: The original Guns N' Roses started basically in 1984 if I remember correctly. Appetite was released in 1987 and the band basically broke up after Spaghetti Incident which was released in 1993. November 23rd, 1993 to be exact. Hmmmmmm. Anyhow, the new band got together in 1994 I believe and most of them are still together minus a few that have left over the years. It's now 2008, so we're looking at basically 14 years the band has been together.

Either way, the new band can play the hell out of the new songs. I should know. I've heard most of them. I'm giddy like a schoolgirl right now. CHINESE DEMOCRACY IS COMING... How do I know this time as I've mentioned it many times throughout the years? Oh I dunno... Go look at the following link:

Best Buy Excluse Release - Chinese Democracy - November 25th, 2008

I'm not going to post the cover art or a screen-cap from Best Buy's site in case something changes, but this is the first real news I've seen for this album. The only issue I'm seeing now is that Axl has not officially commented anywhere about the album, nor has gunsnroses.com been updated which I think is odd? I'm told that is because an official announcement from the GnR camp is coming either on Thursday or sometime after that, so I'm on pins and needles.

Speculation is that the album will have 15 songs on it, but I've heard there is enough material to fill four cd's and still have room for more. In 14 years, I sure hope so....

Don't let us down this time. Release the album finally and make many more.
